Yelm teen sues Nestle over e-coli outbreak

A young Yelm woman is the first in Washington state to file a lawsuit in connection with the e-coli outbreak linked to Nestle cookie dough.

Lindsay Phillips, 18, ate a few pinches of the raw Toll House dough while baking cookies in early May. A few days later, she got really sick.

Her attorney, Bill Marler, said she suffered "extreme stomach cramps, eventually leading to bloody diarrhea. She was eventually hospitalized."

He says Phillips is seeking unspecified damages from Nestle.

The company has recalled all of its refrigerated Toll House cookie dough products. The Toll House refrigerated cookie dough is linked to 70 cases of e-coli in 29 different states.

    Come on people! Cook the stuff! You're not following the directions! And how much is "a few pinches"? Not all pinches are the same.

    Assuming that a product that has never caused illness in the past should be handled carefully seems presumptive. The simple facts are; E.coli is not expected in this product and salmonella, which is, has never been implemented in this product because the eggs are pasteurized (like our Milk, do you follow me?). Similarly, Salmonella is not indicated in peanut butter but it was found last winter in a Virginia plant, so should we cook it before eating it? Ready to bake bread dough give instructions on baking the product but they do not warn against possible death or illness if ignored because that’s not why they say bake it. Ice cream with raw cookie dough and Poptarts too will likely change their recipes as will the warning on the cookies and these type products not that this has happened. Everyone seems so righteously aware once it happens. Oh I knew that. Consumer reports confirmed that over 40 percent of this product is consumed uncooked. From now on, instead of it saying, "Cook first" is will say, "cook it first or you may die". That will be a more effective label. E.coli was there because poop got ground up in the batch. Poop does not belong in our foods, period. As a lethal adulterant, E.coli is not tolerated in any amount in any food. The FDA is revamping the food codes so known risks are identified and eliminated. After 8 years of being left to wander in the "Bushes"....The food inspection standards will make a comeback and we will not be finding poop in our food as often. That should make everyone happier, even the most self righteous and all knowing among us. Nestle made 19 billion in profits last year and has an operating budget of 120 billion. They can afford to make and provide us with clean food. Play nice and have mercy.
